Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SortMeOut ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

2.1 Trial License

Upon downloading SortMeOut, you are granted a limited, non-exclusive, non-transferable license to use the Software for a period of seven (7) days ("Trial Period"). During the Trial Period, you may access all features of the Software subject to the usage limits described below.

2.2 Pro License

Upon purchasing a Pro subscription, you are granted a non-exclusive, non-transferable license to use the Software on a single machine for the duration of your active subscription.

2.3 License Restrictions

You may NOT:

• Copy, modify, or distribute the Software
• Reverse engineer, decompile, or disassemble the Software
• Rent, lease, or lend the Software to third parties
• Use the Software on more than one machine per license
• Circumvent any technical limitations or licensing mechanisms
• Remove or alter any proprietary notices or labels

3. Subscription and Pricing

3.1 Trial Period

The Trial Period begins upon first launch of the Software. After 7 days, the AI Assistant features will be limited unless you subscribe to Pro. File automation features (rules, watching folders, organizing files) remain available.

3.2 Pro Subscription

• Pro subscriptions are billed monthly at $9.99 USD
• Subscriptions automatically renew unless cancelled
• You may cancel at any time; access continues until the end of the billing period
• Prices may change with 30 days notice

3.3 Refunds

Given the 7-day free trial, we generally do not offer refunds for Pro subscriptions. However, we may consider refund requests on a case-by-case basis within 7 days of purchase.

4. AI Assistant Service

4.1 Service Description

The AI Assistant feature uses Anthropic's Claude AI to provide intelligent assistance including file organization, email management, calendar access, contact lookup, presentation creation, and system control. The Image Studio feature uses OpenAI's DALL·E 3 to generate images from text prompts. Both features require an internet connection and are subject to usage limits.

4.2 AI Usage Limits

• Trial: 5 AI requests per day, 3 image generations per day
• Pro: 30 AI requests per day, 3 image generations per day

Daily limits reset at midnight UTC. Unused requests do not roll over.

4.3 Image Generation

Images generated through the Image Studio are created using OpenAI's DALL·E 3 API. Generated images are saved locally on your device. You retain rights to images you create, subject to OpenAI's usage policies.

4.4 AI Accuracy Disclaimer

AI-generated suggestions are provided for convenience and may not always be accurate or appropriate. You are responsible for reviewing and approving any actions suggested by the AI before they are executed.

5. Intellectual Property

SortMeOut, including all code, design, graphics, and documentation, is the exclusive property of SortMeOut and its licensors. All rights not expressly granted are reserved.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SORTMEOUT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SOFTWARE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Data and Privacy

Your use of SortMeOut is also governed by our Privacy Policy. By using the Software, you consent to the collection and use of information as described therein.

9. Termination

We may terminate or suspend your license immediately if you violate these Terms. Upon termination:

• Your license to use the Software ends
• You must uninstall and destroy all copies of the Software
• No refunds will be provided for terminated accounts

10. Updates and Changes

We may update the Software and these Terms from time to time. Continued use after changes constitutes acceptance of the new Terms. Major changes will be communicated through the Software or our website.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
